Kenya succession paperwork: start with the Judiciary’s own document index

A narrow guide to locating Kenya Judiciary succession resources and preparing questions without treating a form catalogue as legal advice.

Important: For general educational information only. This is not legal, tax or financial advice, and reading it does not create a professional-client relationship. Laws and procedures vary by jurisdiction and can change. Consult a qualified professional in each place relevant to you and your assets before making decisions.

Find the official resource before using a copied form

The Kenya Judiciary’s official forms page lists a “Probate and Administration Central Electronic Registry Form” as a PDF. The High Court of Kenya’s succession-cases page links to an item titled “FAQs ON SUCCESSION”; its record says the document was created and last updated on 22 September 2025. These pages are useful starting points for finding court-published materials rather than relying on an old file passed around informally.

The public catalogue pages identify the resources, but the form listing alone does not explain which document a particular family must file, and the FAQ download page does not establish an answer to an individual legal question. Open the current court materials directly and ask the relevant registry or a qualified Kenyan practitioner to confirm what applies.

Questions to bring to an adviser

  • Am I looking at a resource published on an official Kenya Judiciary or High Court page?
  • Is the form or guidance current, and does the court identify a later version?
  • Who can confirm which procedure applies to the actual estate?

Prepare a factual file, not a conclusion about entitlement

Before contacting a lawyer or court office, organize the deceased person’s identity and death records, any will or previous court papers, family and contact information, and a list of known assets and debts. Record where each original is held and mark details that are uncertain or disputed. This is a preparation checklist, not a list of Kenya filing requirements.

Keep sensitive originals secure and make a separate index of the records you can produce. If property, residence or family members connect the matter to another country, flag that for local advice instead of assuming that one Kenyan court resource answers every cross-border question.

Questions to bring to an adviser

  • Which details are supported by records, and which still need checking?
  • Are there existing wills, applications or court documents to disclose?
  • Do any assets or family circumstances require advice in another jurisdiction?

Use the court pages as a route to advice, not a decision

This article is limited to the Kenya Judiciary’s public forms catalogue and the High Court’s page identifying its succession FAQ document. It does not summarize Kenyan succession law, explain the contents of the downloadable materials, identify a required filing, or determine who may administer or inherit. Confirm current instructions with the court and a qualified Kenyan lawyer before filing, transferring property or relying on a legal conclusion.

This is general information, not legal, tax, financial or court-filing advice. It has not been reviewed by a lawyer or human editor; consult qualified local counsel in Kenya and have the current official materials checked against the facts before acting.

Questions to bring to an adviser

  • Has the current material itself been read rather than inferred from its title?
  • What current court instructions and documents does this particular matter require?
  • Which qualified Kenyan adviser can review the full facts and records?
